  1. Scope of Application and Purpose of the Service

These Terms and Conditions (hereinafter: “T&C”) govern the contractual relationship between the platform Domus-Suisse.ch (hereinafter: “the Platform”) and any natural or legal person who uses the website, creates an account, or publishes advertisements (hereinafter: “the User” or “the Client”).

Definition of the Service: Domus-Suisse.ch is a digital platform for advertising placement and lead generation. It provides a visibility and prospect generation service.

 

Under no circumstances shall the Platform act as an estate agent, broker, representative, landlord, or contracting party to any transactions (sale or lease) that may result from the use of the website.

  1. Access, Registration, and Account Security
  • Accuracy of Data: Registration on Domus-Suisse.ch requires the provision of complete, accurate, and truthful information.
  • Confidentiality: Access credentials (e-mail and password) are strictly personal and confidential. Any action performed using these credentials shall be deemed to be carried out by the registered account holder.
  • Right of Refusal: The Platform reserves the right to suspend, restrict, or delete any user account unilaterally, at any time and without specifying reasons, particularly in the event of a breach of these T&C.
  1. General Provisions Relating to Advertisements
  • Image Rights and Intellectual Property: The advertiser guarantees that they hold all necessary rights (copyright, property rights) to the photographs, plans, logos, or texts uploaded to the Platform.
  • Prohibited Content: Misleading, false, discriminatory content, or disguised advertising (promoting third-party businesses or services other than the real estate property itself) is strictly prohibited.
  1. Strict Rules for Insertion and Publication of Advertisements

In order to maintain the quality, clarity, and reliability of the marketplace, each advertiser undertakes to strictly comply with the following editorial and technical rules when submitting an advertisement:

4.1. Actual Existence and Availability of Properties

  • Location: Only real estate properties located within the territory of Switzerland or the Principality of Liechtenstein may be published.
  • Effective Availability: The advertisement must correspond to a property that is genuinely available for sale or lease. Property-wanted advertisements (e.g., “Looking for an apartment to rent”) are not permitted.
  • Immediate Update: As soon as a property becomes the subject of a promise to purchase, a signed sale contract, or a concluded lease agreement, the advertiser is under a strict obligation to immediately deactivate or delete the advertisement from the Platform.

4.2. Content and Structure of the Advertisement

  • Principle of Uniqueness (One Advertisement = One Property): Each insertion must feature only one specific real estate property. It is prohibited to group multiple separate properties within a single advertisement or to modify an existing advertisement to substitute a new property.
  • Mandatory Disclosures: The advertiser must accurately disclose the sale price or net rent (including ancillary charges, where applicable), exact location, surface area or number of rooms, and contact details.
  • Rules for Titles and Descriptions: The title and description must faithfully describe the property. It is prohibited to insert telephone numbers, prices, e-mail addresses, or URL links directly into the title of the advertisement.
  • Visual and Typographical Abuse: The abusive use of capital letters, special characters, or repetitive emojis, intended solely to manipulate search algorithms or artificially attract attention in result lists, is prohibited.

4.3. Requirements for Images and Media

  • Quality and Relevance: Uploaded images must exclusively depict the real estate property concerned or its immediate surroundings. Company logos or promotional text will not be tolerated as the main image.
  • Prohibition of Stock Images: The use of generic stock images (non-representative database images) is prohibited. 3D renderings or professional architectural plans are permitted only for new construction projects or properties undergoing renovation.

4.4. Sanctions for Non-Compliance

The Platform reserves the right to modify, suspend, or permanently delete, without prior notice or compensation, any advertisement that breaches these insertion rules.

  1. Prices, Invoicing, and Payment Terms
  • Business Model: Rates for publishing advertisements or subscribing to enhanced visibility options are determined in accordance with the tariff in force at the time of the order.
  • Payment and Default: Unless otherwise agreed in writing, services are payable in advance via the secure payment methods provided on the website. Where invoicing on account is granted (reserved for professional clients), the payment term is 30 days. Upon expiry of this term, default interest at a rate of 5% per annum (Art. 104 Swiss Code of Obligations) shall become due without prior notice.
  • No Refund: In the event of early deletion of an advertisement by the Client (e.g., because the property was successfully leased faster than anticipated), no pro rata temporis refund or credit note shall be due.
  1. Exclusion of Warranty and Limitation of Liability (Art. 99 et seq. CO)
  • Content of Advertisements: The Platform performs only a formal and technical compliance check of the advertisements. It does not warrant the accuracy, completeness, truthfulness, or quality of the information provided by advertisers.
  • Third-Party Contractual Liability: Any lease agreement (Art. 253 CO) or real estate sale contract (Art. 216 CO) is concluded exclusively between the owner/property manager and the interested party. The Platform disclaims all liability for disputes arising from such legal transactions.
  • Technical Availability: The Platform endeavours to ensure continuous access to the website but does not guarantee 100% technical availability. Interruptions for maintenance or due to force majeure shall not entitle the user to price reductions or compensation.
  • Statutory Limitation: The liability of Domus-Suisse.ch is excluded to the maximum extent permitted by Swiss law (exclusion applies to light and ordinary negligence).
  1. Data Protection and Prohibition of Scraping
  • Personal Data: The processing of User data is governed by the Platform’s Privacy Policy, in strict compliance with the Swiss Federal Act on Data Protection (FADP / DSG).
  • Prohibition of Extraction: It is strictly prohibited to automatically extract, copy, reuse, or collect (by means of scraping, bots, or any other technical process) data, advertisements, contact details, or images present on Domus-Suisse.ch for republication on other media or for commercial direct marketing.
  1. Amendments to the T&C

The Platform reserves the right to amend these T&C at any time. Registered Users will be notified of amendments via e-mail or through a notification in their personal account space. Continued use of the services after the amendments come into force shall constitute acceptance of the new provisions.

  1. Governing Law and Jurisdiction
  • Governing Law: These T&C and all legal relationships arising therefrom shall be governed exclusively by substantive Swiss law, to the exclusion of conflict of laws rules.
  • Jurisdiction: Any dispute arising out of or in connection with these conditions or the use of the Platform shall be subject to the exclusive jurisdiction of the courts at the registered office of the operating company of the platform, namely Zurich, Switzerland.
